This Participation Waiver, Release of Liability, and Assumption of Risk Agreement (“Agreement”) is entered into by the undersigned participant (“Participant”) and JP Sporting Development (“JPSD”), operated by Jereme “JP” Tayamen, an insured sporting clays coach.

For purposes of this Agreement, the “Released Parties” include JP Sporting Development, Jereme “JP” Tayamen, and their respective owners, employees, authorized instructors, contracted coaches, agents, representatives, successors, and assigns, acting within the scope of JPSD activities.

The Participant acknowledges that participation in sporting clays instruction and related shooting activities is voluntary and involves the use of firearms, ammunition, moving targets, and potentially hazardous environments.

BY SIGNING THIS AGREEMENT, THE PARTICIPANT ACKNOWLEDGES THAT THEY ARE VOLUNTARILY ASSUMING SIGNIFICANT RISKS AND RELEASING CERTAIN LEGAL RIGHTS, INCLUDING CLAIMS ARISING FROM ORDINARY NEGLIGENCE, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

This Agreement applies to activities occurring during the period specified in the acknowledgment and signature section, subject to applicable law.

3. Acknowledgment of Inherent Risks

The Participant understands that sporting clays and related shotgun shooting activities are inherently dangerous and can result in serious bodily injury, permanent disability, property damage, or death.

The Participant understands and acknowledges that risks may include, but are not limited to:

Firearm-Related Risks

  • Misunderstanding or failing to follow coaching instructions
  • Loss of firearm control during mounting, swinging, or shooting
  • Physical strain, fatigue, or other injuries associated with instruction
  • Delays in receiving emergency medical assistance

The Participant acknowledges that these examples do not constitute an exhaustive list of all possible risks.

THE PARTICIPANT EXPRESSLY UNDERSTANDS THAT FIREARM-RELATED ACTIVITIES MAY RESULT IN CATASTROPHIC INJURY OR DEATH, EVEN WHEN REASONABLE SAFETY PRECAUTIONS ARE FOLLOWED.

4. Voluntary Assumption of Risk

The Participant voluntarily elects to participate in the activities provided by JPSD with full awareness of the risks involved.

The Participant knowingly and freely assumes all inherent risks, whether known or unknown, associated with participation, including risks arising from the actions of other shooters, environmental conditions, equipment malfunctions, and the ordinary negligence of the Released Parties, to the fullest extent permitted by applicable law.

The Participant understands that JPSD cannot guarantee a completely risk-free environment.

The Participant further understands that professional instruction, safety procedures, range rules, and insurance coverage do not eliminate all risks associated with firearms or recreational shooting activities.

5. Release of Liability and Waiver of Claims

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE PARTICIPANT HEREBY RELEASES, WAIVES, AND DISCHARGES THE RELEASED PARTIES FROM CLAIMS FOR BODILY INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE ARISING OUT OF OR RELATING TO PARTICIPATION IN THE COVERED ACTIVITIES, INCLUDING CLAIMS CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF ANY RELEASED PARTY.

This release includes claims involving ordinary negligent acts or omissions relating to instruction, supervision, equipment, activity organization, or range operations, to the extent those claims may lawfully be released.

The Participant intends this release to apply to claims brought by the Participant and, to the extent legally permissible, the Participant’s estate, personal representatives, heirs, or successors.

THIS AGREEMENT DOES NOT PURPORT TO RELEASE GROSS NEGLIGENCE, RECKLESS MISCONDUCT, INTENTIONAL WRONGDOING, OR ANY OTHER LIABILITY THAT CANNOT LAWFULLY BE WAIVED.

The Participant acknowledges that this release is a material condition of participating in JPSD activities.

6. Participant Responsibility and Firearm Safety

The Participant agrees to follow all applicable firearm safety rules, posted range regulations, and lawful instructions provided by JPSD personnel or authorized range officials.

The Participant specifically agrees to:

  1. Treat every firearm as if it is loaded.
  2. Maintain firearm muzzle control and keep the muzzle pointed in a safe direction.
  3. Keep their finger off the trigger until prepared and authorized to shoot.
  4. Confirm the intended target and maintain awareness of the surrounding shooting environment.
  5. Follow all loading, unloading, and shooting instructions.
  6. Use appropriate eye and hearing protection during live-fire activities.
  7. Immediately disclose firearm malfunctions or unsafe equipment conditions.
  8. Never handle firearms while under the influence of alcohol, illegal drugs, or any substance that impairs judgment or coordination.
  9. Avoid horseplay, reckless behavior, and unauthorized firearm handling.
  10. Immediately notify the instructor or range personnel of any unsafe condition, injury, or emergency.

The Participant understands that failure to comply with safety procedures may result in immediate removal from instruction or participation.

JPSD reserves the right to suspend or terminate participation whenever an instructor reasonably determines that continued activity presents an unacceptable safety risk.

7. Participant Health and Physical Condition

The Participant represents that they are physically and mentally capable of participating safely in the selected activities, or that they have disclosed relevant limitations and discussed appropriate accommodations with JPSD.

The Participant understands that shooting activities may require standing, walking, maintaining balance, operating equipment, and controlling shotgun recoil.

The Participant agrees to inform JPSD of any condition, injury, limitation, or accommodation need that could reasonably affect safe participation.

The Participant is responsible for determining whether medical consultation is necessary before participating.

Nothing in this Agreement requires the Participant to disclose unrelated personal medical information.

8. Firearms, Ammunition, and Equipment

The Participant understands that firearms and ammunition must be suitable for the intended shooting activity.

When the Participant provides personal equipment, the Participant is responsible for presenting that equipment in a reasonably safe and functional condition and for complying with applicable laws and range requirements.

JPSD may inspect or decline the use of equipment when safety concerns are identified.

The Participant agrees not to use ammunition prohibited by the hosting range or JPSD.

When JPSD provides rental or loaned equipment, the Participant agrees to operate the equipment only in accordance with authorized instructions.

The Participant may be financially responsible for damage to JPSD equipment caused by misuse, intentional misconduct, or negligent handling, subject to applicable law and the terms of any separate rental agreement.

JPSD does not guarantee the security of unattended personal property.

9. Transportation and Range Vehicles

When transportation is provided or authorized as part of a JPSD activity, the Participant acknowledges the risks associated with golf carts, utility vehicles, side-by-side vehicles, and other range transportation.

These risks may include collisions, rollovers, falls, uneven terrain, and injuries during boarding or exiting.

The Participant agrees to follow vehicle safety instructions, use installed safety equipment as directed, remain seated when required, and avoid distracting the operator.

Only authorized individuals may operate vehicles supplied or controlled by JPSD.

The Participant voluntarily assumes the inherent risks of authorized transportation activities, subject to the release and limitations stated in this Agreement.

10. Medical Emergencies and Treatment

In the event of an injury or medical emergency, the Participant authorizes JPSD personnel to contact emergency medical services and provide available emergency contact information to responding personnel when reasonably necessary.

When the Participant is unable to provide consent, the Participant authorizes JPSD to request appropriate emergency medical assistance, subject to applicable law.

The Participant understands that JPSD personnel may not be licensed medical professionals and cannot guarantee immediate medical treatment or a particular medical outcome.

The Participant acknowledges responsibility for medical expenses incurred on their behalf, except to the extent another party is legally responsible.

This section does not waive claims for misconduct or liability that cannot lawfully be released.

11. Personal Insurance and JPSD Insurance Disclosure

The Participant understands that JPSD is operated by Jereme “JP” Tayamen, an insured sporting clays coach.

The Participant acknowledges that JPSD’s insurance coverage is governed by the applicable insurance contracts, including their terms, conditions, exclusions, and limits.

JPSD’S STATUS AS AN INSURED COACHING BUSINESS DOES NOT GUARANTEE THAT ANY PARTICULAR INJURY, ACCIDENT, CLAIM, PARTICIPANT, OR ACTIVITY IS COVERED BY INSURANCE.

The Participant is encouraged to maintain appropriate personal health and other insurance coverage.

No provision of this Agreement is intended to eliminate an insurer’s independent contractual obligations or any legally established rights of an injured person.

12. Third-Party Shooting Facilities

JPSD may conduct lessons, clinics, and other activities at shooting clubs or facilities that are not owned or operated by JPSD.

The Participant agrees to comply with the policies and safety requirements of each hosting facility.

The Participant understands that a hosting facility may require a separate participation waiver, liability release, or acknowledgment of its own terms.

Signing this Agreement does not automatically replace any document required by a third-party facility.

The Participant understands that JPSD may not control every aspect of a third-party location, including maintenance, facility conditions, or actions of unrelated shooters and visitors.

This Agreement does not automatically release an independently operated shooting facility or unrelated third party from liability.

13. Participant Indemnification

To the extent permitted by law, the Participant agrees to indemnify and hold the Released Parties harmless from third-party claims, losses, damages, or reasonable legal expenses arising from the Participant’s intentional misconduct, violation of firearm safety rules, unlawful conduct, or negligent acts causing injury or damage to another person or their property.

This obligation does not require the Participant to indemnify any Released Party for that Released Party’s own negligence or other wrongful conduct, except to the extent expressly permitted by law and clearly agreed to in a separate enforceable provision.

14. No Guarantee of Performance or Results

The Participant acknowledges that sporting clays instruction involves individualized coaching, skill development, and continued practice.

JPSD does not guarantee any particular improvement in shooting scores, competitive classification, tournament results, or shooting performance.

Instructional outcomes may vary based on the Participant’s experience, practice, physical capabilities, equipment, and ability to apply coaching recommendations.

15. Photography, Video, and Coaching Records

The Participant acknowledges that video recording or photography may be used during instruction for legitimate coaching purposes, including the evaluation of gun movement, technique, target engagement, and shooting performance.

Private instructional recordings and student coaching records will be handled in accordance with JPSD’s Privacy Policy.

This Agreement does not grant JPSD unrestricted permission to use the Participant’s name, image, or likeness for public advertising or promotional purposes.

Any public promotional use requiring consent will be addressed through a separate media release or other appropriate authorization.

16. Governing Law and Severability

This Agreement shall be interpreted under the laws of the State of Florida, except where another jurisdiction’s mandatory laws govern a claim or dispute.

If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain effective to the extent permitted by law.

No provision shall be interpreted to eliminate rights that cannot lawfully be waived.

17. Participant Acknowledgment

By signing this Agreement, the Participant expressly acknowledges that:

  • They have read and understand the entire Agreement.
  • They understand that sporting clays and other firearm-related activities carry significant risks of injury and death.
  • They understand that they may refuse to participate.
  • They agree to follow all applicable firearm and range safety requirements.
